Don Morton was admitted to practice in 1966, and following a tour of duty in Vietnam with the U.S. Army, commenced a general practice with emphasis on civil litigation, business law, real estate, and probate. While in law school, Mr. Morton clerked for Judges John M. Ryan, G. Remy Bierly, and French Clements of the Indiana Court of Appeals.
Mr. Morton handled many civil cases while in the general practice before directing his attention primarily to the representation of electric utilities. Mr. Morton devoted much of his career to the duties of General Counsel for Wabash Valley Power Association, a generation and transmission utility. In this capacity, he directed numerous complex litigation matters, including a major antitrust case resulting in millions of dollars’ savings annually to his client and litigation relating to a failed nuclear power plant involving the review of millions of documents and the development of a litigation support system. In addition, Mr. Morton has been involved in administrative agency cases at the state and federal level. These are primarily state public service commission cases, and at the federal level, matters before the Federal Energy Regulatory Commission. During his career, Mr. Morton has been responsible for several major financings, bond issues, and pollution control financings.
In addition, Mr. Morton led the legal team creating the corporate and governance documents for ACES Power Marketing, a sophisticated trading organization representing many generation and transmission cooperatives in the United States. Mr. Morton also was responsible for the corporate and governance documents of the National Renewables Cooperative Organization a national organization whose members are primarily non-profit electric cooperatives interested in developing renewable energy projects. Mr. Morton was Vice Chairman of the committee responsible for the development of the corporate and governance documents for the Midwest Independent Transmission System Operator, Inc. (Midwest ISO). The Midwest ISO is responsible for the delivery of electric power across 13 U.S. states and the province of Manitoba Canada.
Mr. Morton’s experience with complex business organizations is a valuable asset to clients developing new business entities. He has often assisted with the development of small entrepreneurial business, including family entities, which may be for profit or not for profit businesses in a wide variety of undertakings. He has often helped business owners with their estate planning needs to transition their business affairs to the next generation.
